The Scope and Applicability of the UETA The UETA applies only to e-records and e-signatures relating to a transaction (an interaction between two or more people relating to business, commercial or governmental activities). The UETA does not apply to laws governing wills or testamentary trusts, the UCC (except Articles 2 and 2A), the UCITA, and other laws excluded by the states. B. The Federal E-SIGN Act and the UETA If a state enacts the UETA without modification, the E-SIGN Act does not preempt it. The E-SIGN Act does preempt modified versions of the UETA to the extent that they are inconsistent with the E-SIGN Act. Under the E-SIGN Act, states may enact alternative procedures or requirements for the use or acceptance of e-records or e-signatures if (1) those procedures or requirements are consistent with the E-SIGN Act, (2) the state’s procedures do not give greater legal effect to any specific type of technology, and (3) if the state adopts the alternative after the enactment of the E-SIGN Act, the state law must refer to the E-SIGN Act. C. Highlights of the UETA State versions may vary. 1. The Parties Must Agree to Conduct Transaction Electronically This agreement may be implied by the circumstances and the parties’ conduct (for example, giving out a business card with an e-mail address on it). Consent may also be withdrawn. 2. Parties Can â€Å"Opt Out† Parties can waive or vary any or all of the UETA, but the UETA applies in the absence of an agreement to the contrary. 3. Attribution The effect of an e-record is determined from its context and circumstances. A person’s name is not necessary to give effect to an e-record, but if, for example, a person types her or his name at the bottom of an e-mail purchase order, that typing qualifies as a â€Å"signature† and is attributed to the person. Any relevant evidence can prove that an e-record or e-signature is, or is not, the act of the person. If issues arise relating to agency, authority, forgery, or contract formation, state laws other than the UETA apply. 4. Notarization A document can be notarized by a notary’s e-signature. 5. The Effect of Errors If the parties agree to a security procedure and one party does not detect an error because it did not follow the procedure, the conforming party can avoid the effect of the error [UETA 10]. If the parties do not agree on a security procedure, other state laws determine the effect of the mistake. To avoid the effect of an error, a party must (1) promptly notify the other of the error and of his or her intent not to be bound by it and (2) take reasonable steps to return any benefit or consideration received. If restitution cannot be made, the transaction may be unavoidable. 6. Timing An e-record is sent when it is properly directed from the sender’s place of business to the intended recipient in a form readable by the recipient’s computer at the recipient’s place of business that has the closest relation to the transaction (or either party’s residence, if there is no place of business). Once an e-record leaves the sender’s control or comes under the recipient’s control, it is sent. An e-record is received when it enters the recipient’s processing system in a readable form—even if no person is aware of its receipt.

Effect of English Language in the World At the present time communication and traffic are growing, and globalisation has linked the world more closely together. The world becomes smaller and smaller every day; technology is constantly updated, business contacts and information sharing speed is also accelerating. This project investigates English as an international language and evaluates its effect on international business and marketing. This project aims to identify the advantages and disadvantages of English as a global language with specific reference to marketing. Firstly, this project will critically appraise the importance of language to culture. The project will then go to investigate the present position of English as an international language in marketing, followed by a critical appraisal of the advantages and disadvantages of English international language in marketing. Chapter 1: Introduction The English language is used as a global international language. I chose to do a literature based survey on English as an international language because I am interested in this. According to Crystal (2003) there are 320-380 million people whose first language is English, 300-500 million people whose second language is English and a number of about 500-1000 million people who recognize the importance of English as an international language. The history of English language began over 1500 years ago. In 1066, the Normans conquered the English. French became the language of the rich and powerful, but the poor primarily spoke English. In the 14th century, the British used many words from French or Latin, and much of the vocabulary no longer exists. However, as Britain began to be more powerful and build up an empire, from the about the end of the 17th century, the English language became more important. English has become a world language because of its establishment as a mother tongue outside England Above all, it is the great growth of population in the United States that has given English its present standing in the world. (Soars, 1986:52) This project investigates English as an international language and evaluates its effect on international business and marketing. This research aims to identify the advantages and disadvantages of English as a global language with specific reference to marketing. Firstly, this project will critically appraise the importance of language to culture. Chapter 2: Literature review There are many people speak English now. And David Crystalà ¯Ã‚ ¼Ã‹â€ 2003à ¯Ã‚ ¼Ã¢â‚¬ ° said that there are 320-380 million people refers to the traditional bases of English, where it is the primary language: It includes the USA, UK, Ireland, Canada, Australia, and New Zealand. Above all, it is the great growth of population in the United States, assisted by massive immigration in the nineteenth and twentieth centuries that has given the English language its present standing in the world. An d Crystal support that there are seen kinds of answer given to the question: historical reasons, internal political reasons, external economic reasons, practical reasons, intellectual reasons, entertainment reasons, and some wrong reasons. Why English language is a branding? According to Maggie St. John (1992) said that the most basic concept underling marking is that of human needs and marketing has become a key factor in the success of western businesses. Because English language include this points, so English language is a branding. Chapter 3: Methodology I chose to do a literature based survey on English as an international language because I am interested in this. It was therefore necessary to get more information about this topic. I used books and relevant e-journals from the JMU library and got help from my tutor. The objective of this research question is to evaluate the effect of English as an international language on international business and marketing and then to identify the advantages and disadvantages for business and marketing. Hopefully this research will be useful research because there are many people studying English and they do not really know why; they just know they need to study to find a good job. This research will perhaps make people see more clearly why they need to learn English, not just to look for a job. In order to make this information valid and reliable, I will make a questionnaire and send it to 20 or more people learning English; 10 come from China and 10 come from the other people whose first language is not English. The questionnaire sheet will sent by e-mail to my friends. If I had more time it would be possible to do a much bigger, more representative survey. Chapter 4: Analysis and findings 4.1 To critically appraise the importance of language to culture. In the same way that the surgeon, operating on the heart, cannot neglect the body that surrounds it, so the translator treats the text in isolation from the culture at his peril. (Bassnett, 1991:14) 4.2 To investigate the present position of English as an International Language in marketing. Nowadays, the present position of English as an International Language occupies a high position in marketing. What is marketing? Today market is the commodity economy, the carrier or the actual running performance.  The more developed commodity economy, the market scope and capacity of the more expanded.  The there markets are interrelated meanings. Firstly, there is the sum of commodity producers and consumers of goods of economic relations between the convergences. Second, there is a demand for purchasing power; third is the reality of customers and potential customers. With the development of market economy, all kinds of markets are in development.  With the social interaction, the market is not necessarily true sites and locations.  Social division of labor and commodity market is the inevitable product of economic development.  Meanwhile, the market in its development and strengthening of the process, but also promotes the social division of la bor and the further development of commodity economy.  Market through information feedback, a direct impact on people what is produced, the production number, and time to market, product sales, etc.; join the process of economic development, commodity production, supply, marketing parties, for the production, supply, marketing parties exchange place, exchange  time and other exchange, in order to achieve commodity producers, operators and consumers to their own economic interests. Primary and secondary students to learn English before they can enter university; students pass exams in English, they can not get places; As for the serving staff, English is a compulsory subject title examinations, title means more money, sub-house; those who want to study abroad, no  a certain TOEFL, IELTS (English assessment test), you can not apply for a scholarship; want foreign companies have gained a seat, no t English to work hard to find, even if found, but also the lack of promotion opportunities. The huge demand to learn from the huge crowd, rough statistics, the number of people learning English, just the middle and high school students, has nearly 190 million. According to the Chinese Ministry of Education Statistics 2005, the national junior high school students have 65144000, in the national senior high school students to reach 3990.09 million. à ¯Ã‚ ¼Ã‹â€ Diyazhaoà ¯Ã‚ ¼Ã¢â‚¬ ° 4.3 To critically appraise the advantages and disadvantages of English Language in marketing. We all know there are many advantages of learning English, The usefulness of English far more than meet the test and get a degree that simple. While the United Nations has six official languages, although Chinese is the worlds most widely spoken language, but now, the worlds most widely used language is English.  Chinas largest population, China wants to develop to isolation from the world, to get the world to gain a foothold in the world to seek their own way, will not be the most widely used language that how about other areas?  On second thoughts, we as individuals want to break a world in the world, confined to the domestic is not enough, although the history of closed-door policy has become in the past, but it always warned us to learn foreign advanced science and  technology to develop their own to improve their own!  However, if the language does not pass even the most basic communication can not do, how can we talk about learning and development? B ut few people would think of a disadvantage.  Because people want to learn English, they all feel is a good thing, but people often do not think learning English will let another language extinction.  The people of the world only know 2 languages come from china: Cantonese and Mandarin.  But China has more than the 2 languages.  For example: Hakka.  I am from China, I am also a Hakka, but since I live in a big city in the city led me to only speak Cantonese and Mandarin. But I spoke Hakka when I was small.  However, due to speak Cantonese and Mandarin for a long time resulted in the Hakka dialect pronunciation of my non-standard, and sometimes my family does not understand what I said when I use Hakka.  If this continues, the Hakka may be extinct.  This is just an example. Chapter 5: Conclusion In this research, it enhanced English as a global language, It seems to capture the other indices between the worlds languages, roughly on the number of economic factors or the basis of mother tongue, do not convey the relative relationship between things. The awareness of the importance of language learning is point of departure. Taking into account economic factors has been discussed, including severe language products and open world trade index. Taking into account the human development are index of different countries. It combines education with literacy and the quality of life measures were generated. At least it is not some standard, but far ahead of all other languages, including Chinese. Chapter 6: Recommendations According to my research, this research shows why English as an international language. From this research, we should: firstly, we should know why we learn English. Because if you do not have an objective, and you cannot learn English very well. Finally, you need to know why English as an international language, not your mother language, it will let you know how different from English with your language that you can learn English harder. Chapter 7: Self Evaluation First four weeks This is the first time I have ever done research and I had little confidence, so initially I had trouble finding a topic or expressing a particular idea. I started to get some ideas from the internet. Luckily, I found an idea about English language as an international language from the internet. Although I had an idea, I did not know what I could do next. Then I talked with my teacher and she helped me to finish the research proposal. When I finished the proposal, I did not know how to research the information from books or websites, because there is so much information for me to choose from, I did not know which one is best for my research. Due to having classes taught about how to take notes and avoid plagiarism, I know now how to do these things and I am learning how to look for information. Mid course Midway through this research I had many problems. Firstly, I had toothache and I could not focus on my research and missed some classes, sometime I got so lost that I did not know what I can do next. I also found some books from library, but I did not know how to connect them with my research. Luckily, my tutor has told me how to connect them. I think my classmates are faster than me, so I need to catch up with them Final evaluation This is the final research, from this research; I learned how to write a full research and how to write references. About one hundred years ago the planet earth was a much smaller place. On December 17, 1903 the Wright brothers, Wilbur and Orville, made history when they took off in flight and invented the first airplane. This is how the planet earth began shrinking geographically making it easier and quicker to travel over long distances. Wilbur was the older of the two brothers by four years. Wilbur was born in 1867 on a farm near Millville, Indiana and Orville was born in 1871 near Dayton, Indiana. As youngsters, Wilbur and Orville looked to their mother for mechanical expertise and their father for intellectual challenge. Milton, their father, brought them various souvenirs and trinkets he found during his travels for the church. One such trinket, a toy helicopter-like top, sparked the boys' interest in flying. In school, Wilbur excelled, and would have graduated from high school if his family had not moved during his senior year. A skating accident and his mother's illness and subsequent death kept him from attending college. Orville was an average student, known for his mischievous behavior. He quit school before his senior year to start a printing business. The two brothers were very intellectual and smart, but both did not ever get their high school diplomas. It just goes to show that even two of the best minds in our history didn’t have to go to college or even finish high school to become these great minds. The first time Wilbur and Orville referred to themselves as "The Wright Brothers" was when they started their own printing firm at the ages of 22 and 18. Using a damaged tombstone and buggy parts, they built a press and printed odd jobs as well as their own newspaper. In 1892, the brothers bought bicycles. They began repairing bicycles for friends, then started their own repair business. They opened up a bicycle shop in 1893, and three years later, made their own bicycles called Van Cleves and St. Clairs. While nursing Orville, who was sick with typhoid in 1896, Wilbur read about the death of a famous German glider pilot. The news led him to take an interest in flying. On May 30, 1899, he wrote to the Smithsonian Institution for information on aeronautical research. Within a few months after writing to the Smithsonian, Wilbur had read all that was written about flying. He then defined the elements of a flying machine: wings to provide lift, a power source for propulsio n, and a system of control.

Gavin "the Gray Ghost" Gray is a legendary college football player who marries his homecoming queen sweetheart and embarks on a professional career full of difficulties. â€Å"The Gray Ghost† is a Louisiana football legend. There had never been a better, faster ball player, and everyone knows the hero is headed for pro football. To no one's surprise, Gavin marries his sweetheart, beauty queen â€Å"Babs.† He is a first-draft pick in the pros, as expected, and soon after that, the two begin their family. I was especially interested in this movie because I am, myself, a college athlete. This movie brought out the importance of having a life and goals other than playing a professional sport. Too many young athletes these days have unrealistic goals of going to the pros, while in actuality the chances of them doing so are next to impossible. Many athletes are in college just to play their sport, and do not care about their academic performance. Eventually, the limelight will fade and professional athletes will become has-beens left to reminisce about their â€Å"glory days.† Often in college, athletes will do just enough to get by and not care about what their academic performance means. Unfortunately, especially in some larger schools, preferential treatment for athletes does exist among the faculty. This also gives athletes the advantage at the time, but hurts them in the long run. In the movie, the ideal marriage of Gavin and Babs begins to come apart, when Gavin cannot deal with the loss of the glory he had in his youth.

PEOPLE WHO ARE MAKING A DIFFERENCE IN THE WORLD Thurday 12/03/09 1. I’m Bob Doughty. 2. And I’m Barbara Klein with EXPLORATIONS in VOA Special English. Today we tell about five individuals around the world who are making a difference. They are making the world a better place by helping people in special ways. 1. Our first individual who is making a difference is a refugee from Burma. Thousands of people flee Burma each year to escape poverty, oppression and civil war. Many of them choose to stay in Thailand. Cynthia Maung is a Burmese doctor who operates a small public health center near the Thai border with Burma.She is making a difference in her community by providing services that are not available to most people in this area. 2. Many people are waiting at the public health center. Mothers and their children wait in line to get vaccines to protect them against diseases. In another line, parents with newborn babies wait for documents that show their babies were born i n Thailand. The documents take the place of birth certificates. Thai officials do not recognize these people because they are refugees. But Doctor Cynthia Maung does. 1.Doctor Cynthia, as she is called, fled Burma in nineteen eighty-eight after a military campaign against people who demonstrated for democracy and justice. She says she joined with the demonstrators. She says people started disappearing or fleeing to the border when Burma’s military seized power. She decided to settle near the border to work for political change. 2. In a small building, Cynthia Maung started performing operations and helping women give birth. She cleaned her instruments in a rice cooker. She also trained young volunteer health workers.Today, those workers treat people for landmine injuries and many diseases. Her health care center receives donations of money from non-governmental organizations and foreign governments, including the United States. 1. Doctor Cynthia makes a little money go a long way. Each year, one hundred fifty thousand people come for treatment. Those who can, pay less than one dollar. 2. Doctor Cynthia lives next to the health center. She says the workers there do not only treat diseases. They also educate young people who go back and support health activities in their communities.For example, the center trains volunteer health workers who go back to work in the ethnic Karen and other areas of Burma. Some of the volunteers are former patients who are now helping others. Doctor Cynthia says young people should be taught not to feel like victims. Instead, she says, they should see themselves as people who can change and improve their situation. 1. Theary Seng is a human rights activist working to heal her country, Cambodia. As a child, she lived through the rule of the Khmer Rouge during the nineteen seventies.During four years in power, the Khmer Rouge was responsible for the deaths of at least one million, five hundred thousand Cambodians. Theary Sengâ €™s parents were among those killed. After the fall of the Khmer Rouge, she escaped to Thailand and then went to the United States. She attended law school and became a lawyer. 1. Now, Theary Seng is back in Cambodia, supporting human rights as the head of the Center for Social Development. She is a critic of corruption and abuse wherever it exists — in Cambodia and around the world.At a recent demonstration in Phnom Penh, she attempted to leave flowers to honor those killed in the civil war in the Darfur area of Sudan. But Cambodian government officials prevented her from doing so. 2. Theary Seng takes a special interest in the Khmer Rouge Tribunal. The court is starting to take legal action against former Khmer Rouge leaders for their crimes. She serves as an official representative for the victims. 1. She also has a television show. It seeks to find the country’s next generation of young leaders.Theary Seng says her work is not to do anything big but to be a com mon citizen in her homeland where she suffered in the past. THEARY SENG: â€Å"And now, I’m taking that suffering, and shaping it into hope, and trying to work with individuals who had not the time and space to heal that I’ve had. † 1. Mister Saydee is a clergyman and former accountant. (SOUND) He now works as a typist and teacher. He is teaching unemployed Liberians how to type.The students do not pay him anything. One of the students is Isaiah Thomas. He says he is learning to type because he wants to work for an international company. 2. William Saydee says he wants to help young people gain a skill to succeed. He says it is the best he can do to help Liberia re-build after years of civil war. Mister Saydee earns money by typing contracts and other documents, like resumes. A resume is a list of a personâ€⠄¢s education and work experience. It can be useful when a person is looking for a job. (MUSIC) 1. Comic book artist Robert Walker is making a difference in New York City.He uses his art to help people understand the disease AIDS. Many children and even adults in the United States enjoy reading comic books. Superheroes in comic books have unusual abilities. They use their abilities to help people and save the world. Like most superheroes, Mister Walker’s characters have special powers. For example, one superhero can see in the dark. One can lift more than three hundred tons. Another can come back from the dead. Also, like most superheroes, his characters have to deal with trouble. These superheroes all have H. I. V. , the virus that causes AIDS.Mister Walker says some members of his family died of AIDS when he was a child. That gave him the idea to create a comic book called â€Å"O Men. † It includes nine characters living with H. I. V. The characters are men and wome n who represent different races and socio-economic groups. They also were infected with the virus in different ways. Mister Walker says he wanted to fight depressing images connected with the disease. ROBERT WALKER: â€Å"It’s not a black disease. It’s not a white disease. It’s not a gay disease. It’s a disease of humanity that lacks awareness. † 1.Gerry Gladston is the co-owner of Midtown Comics in New York City. He says many comic books have important political, social and educational messages. Mister Walker spoke to many H. I. V. and AIDS organizations in researching his comic book. He says he wanted to make the stories realistic as well as factual. 2. Yohannes Gebregiorgis is an Ethiopian-American who returned to the land of his birth to make a difference. Yohannes, as he is known, became an American citizen many years ago. But he gave up his life as a children’s librarian in San Francisco, California.Yohannes says he was concerned that Ethiopian children had no books. He said most schools in Ethiopia do not have libraries. There are almost no children’s books in any of Ethiopia’s many languages. So Yohannes started the Donkey Mobile Library to provide children with their first books. His group brings books to children who have none. YOHANNES GEBREGIORGIS: â€Å"Most kids we have noticed holding a book upside down. We have taken pictures of those kids. But later on we find out that those kids learn how to use the book, how to flip the pages and to look at the pictures and then gradually to read the stories in the book. 1. More donkey mobile libraries are planned, with money from groups in the United States. Donated English-language books have begun arriving in Ethiopia. Also, Yohannes has established a publishing company to produce books in languages that local children can read. His first book was published in three languages. It is a re-telling of an old folk story about, what do you think? A boy a nd his favorite animal — a donkey! 2. In the beginning, children came to the mobile library mainly because of the donkeys. But Yohannes discovered that what really excited the children was the books.He dreams about taking his donkey mobile libraries to more Ethiopian towns and villages.
